Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of hypertargetmarketing.com (the “Site”) and the advertising, call-routing, and lead-distribution services of HyperTarget Marketing (“HyperTarget,” “we,” “us”) (the “Services”). By using the Site or Services you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site. Publishers participating in our network are additionally bound by our Publisher Agreement.

1. The Services

HyperTarget is a performance-marketing network. We connect consumers who respond to advertising with independent businesses, primarily by routing inbound phone calls and leads. We are not the provider of the underlying consumer services advertised in any campaign, and any agreement for such services is solely between the consumer and the business they engage.

2. Eligibility

You must be at least 18 years old to use the Site or Services. By submitting information, you represent that it is accurate and your own (or that you are authorized to submit it).

3. Consent to contact

Where a form or call flow includes consent language, submitting that form or completing that call constitutes your agreement to be contacted as described there by us and participating businesses, by phone, text, and email. Consent is not a condition of purchase, and you may revoke it at any time as described in our Privacy Policy.

4. Independent businesses; no endorsement or guarantee

Businesses that receive calls or leads through our network are independent third parties. We do not employ, control, endorse, or guarantee them, and we make no representation about their licensing, qualifications, pricing, availability, or the quality of their products or services. You are responsible for evaluating any business before engaging it.

5. Prohibited use

You agree not to submit false or fraudulent information; not to use bots or automated means to submit forms or generate calls; not to interfere with or attempt to gain unauthorized access to the Site; and not to use the Site or Services in violation of any applicable law, including telemarketing and consumer-protection laws.

6. Intellectual property

The Site and its content (text, graphics, logos, and software) are owned by or licensed to HyperTarget and protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works from Site content without our written permission, except for personal, non-commercial viewing.

7. Third-party links

The Site may link to third-party sites and services. We are not responsible for their content or practices, and your dealings with them are solely between you and them.

8. Disclaimer of warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HYPERTARGET AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY DAMAGES ARISING FROM PRODUCTS OR SERVICES PROVIDED BY ANY INDEPENDENT BUSINESS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless HyperTarget and its officers, employees, and agents from claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site or Services, your violation of these Terms, or information you submit.

11. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. You and HyperTarget consent to the exclusive jurisdiction and venue of the state and federal courts located in Travis County, Texas.

12. Changes; severability; entire agreement

We may update these Terms from time to time by posting the updated version here with a new effective date; continued use after changes constitutes acceptance. If any provision is found unenforceable, it will be limited or severed and the remainder will remain in effect. These Terms, the Privacy Policy, and (for network participants) the Publisher Agreement are the entire agreement regarding the Site and Services.
